Agreement
These Terms of Service ("Terms") are a legal agreement between you and AzAd Labs for use of AzAd Workspace, AzadMail, Azad Contacts, the admin console, and related services (the "Services"). If you use the Services on behalf of an organization, you represent that you have authority to bind that organization. If you do not agree, do not use the Services.
The Services
We provide hosted email, contacts, and administration tools. Features may change; some products (such as Todos or CRM) may be labeled "coming soon" and are not yet generally available. We strive for high availability but do not guarantee uninterrupted or error-free operation.
Accounts and access
You are responsible for safeguarding your credentials and for activity under your account. Organization administrators may provision, suspend, or remove mailboxes and may enforce security policies (including multi-factor authentication). Notify your administrator or us promptly if you suspect unauthorized access.
Acceptable use
You agree not to:
- Send spam, phishing, malware, or unlawful content;
- Harass others or violate intellectual property or privacy rights;
- Probe, scan, or attempt to breach systems without authorization;
- Use the Services in a way that harms other users, our infrastructure, or third parties;
- Circumvent usage limits, security controls, or billing restrictions.
We may suspend or terminate access for violations or to protect the Services and users.
Your content
You retain ownership of content you submit. You grant us a limited license to host, transmit, and process that content solely to provide the Services (including backup, search, and delivery). You are responsible for ensuring you have rights to the content you send and store.
Privacy
Our Privacy Policy describes how we handle personal information and is incorporated into these Terms.
Fees
Paid plans, if any, are governed by separate order forms or billing terms presented to your organization. Failure to pay may result in suspension after reasonable notice.
Disclaimer of warranties
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, AZAD LABS AND ITS SUPPLIERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, DATA, OR GOODWILL. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICES IS LIMITED TO THE GREATER OF (A) AMOUNTS YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM OR (B) ONE HUNDRED U.S. DOLLARS (USD $100).
Indemnity
You will defend and indemnify us against claims arising from your content, your use of the Services, or your violation of these Terms, except to the extent caused by our gross negligence or willful misconduct.
Termination
You may stop using the Services at any time. We may suspend or terminate access for breach, inactivity, or operational reasons. Provisions that by nature should survive (including liability limits and indemnity) will survive termination.
Governing law
These Terms are governed by the laws applicable to AzAd Labs's place of business, without regard to conflict-of-law rules. Disputes will be resolved in the courts of that jurisdiction, unless mandatory consumer protections in your country require otherwise.
Changes
We may modify these Terms. We will post updates on this page with a new "Last updated" date. Material changes may also be communicated through the admin console or email where appropriate.
